This Privacy Policy describes how Tim Wijtenburg, LLC, doing business as TimTax ("TimTax," "we," "us," or "our"), collects, uses, and protects information in connection with the website located at asktimtax.com (the "Website") and our text messaging program. It applies to visitors to the Website and to individuals who communicate with us by phone, text message, or our online booking and intake forms.

This policy does not replace or modify the engagement letter, General Terms and Conditions, or any signed IRC Section 7216 consent that governs an active client engagement. Where a client engagement is in place, the engagement letter and its terms control how tax return information is used and disclosed. This policy addresses information collected through the Website and our messaging program, and describes our tax return information practices at a general level for anyone reviewing our privacy practices before becoming a client.

Information We Collect

We collect information you provide directly to us, including:

  • Contact information submitted through our booking or intake forms, such as your name, email address, and phone number.
  • Information you provide when you call, text, or email our office.
  • For engaged clients, tax return information and supporting documents you provide in connection with the services described in your engagement letter.

As of the effective date of this policy, the Website does not run third-party advertising trackers, analytics cookies, or pixel-based tracking scripts. If that changes, this policy will be updated to describe what is added and how to control it.

How We Use Information

  • To respond to inquiries and schedule consultations.
  • To deliver the services described in a signed engagement letter.
  • To send appointment reminders, document requests, and status updates about work in progress.
  • To meet our recordkeeping and legal obligations as a licensed CPA firm.

SMS / Text Messaging Program

Program name: TimTax business line.

Message types: replies to text messages you send us, missed-call and voicemail notices, and appointment or document reminders related to your inquiry or engagement.

Message frequency varies depending on your interactions with our office. Message and data rates may apply.

Reply STOP at any time to opt out of text messages from this number. Reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.

How you opt in: by voluntarily providing your mobile number to our office and consenting to receive texts (for example, through the booking or intake form, during onboarding, or in a call with our staff), or by texting our business line first, you consent to be enrolled in this messaging program and to receive the text messages described above. We do not enroll numbers from purchased lists, third-party referrals, public directories, or any other source.

No sharing of mobile information for marketing. Mobile phone numbers, SMS consent, and text messaging originator opt-in data are not shared with or sold to third parties or affiliates for marketing or promotional purposes. This information is used solely to operate our messaging program and to communicate with you about your inquiry or engagement, and is shared only with the messaging platform provider that transmits the message on our behalf.

Tax Return Information (IRC Section 7216)

For clients under an active engagement, your tax return information is used and disclosed only as permitted by federal law. Any use or disclosure of your tax return information beyond the preparation and filing of your return, including disclosure to team members located outside the United States, occurs only under a separate written consent that you sign. Declining to sign any such consent does not affect our provision of the services described in your engagement letter and does not change your fee. Where a consent involves disclosure of your Social Security number to a preparer located outside the United States, we rely on the data protection safeguard framework required under 26 CFR Section 301.7216-3 and Rev. Proc. 2013-14, and identify that framework in the consent itself.

Data Security

TimTax maintains a Written Information Security Plan addressing administrative, technical, and physical safeguards for client information, built to the FTC Safeguards Rule (16 CFR Part 314), IRS Publication 4557, and the Gramm-Leach-Bliley Act. The plan is reviewed and adopted by our firm's Qualified Individual and is reviewed at least annually.

Data Retention

Contact and intake information from prospective clients who do not engage our services is kept only as long as needed to respond to the inquiry and for a reasonable follow-up period, then deleted or anonymized. For clients under an active engagement, engagement records are retained for six years from completion of the engagement, consistent with our engagement letter, unless a longer period is required by law. Original client records are returned in accordance with your engagement letter and applicable professional obligations.

Sharing With Service Providers

We share personal information only with service providers who need it to help us deliver our services or operate the Website and messaging program, such as our client portal, scheduling, and text messaging platforms. We do not sell personal information.

Your Choices

You may reply STOP to any text message from us to opt out of text messages, or HELP for assistance. You may request access to, correction of, or deletion of your personal information by contacting us using the information below, subject to our legal and professional recordkeeping obligations.

Children's Privacy

The Website and our services are directed to adults seeking tax and accounting services. We do not knowingly collect personal information from children under 13.

Changes to This Policy

We may update this Privacy Policy from time to time. The effective date at the top of this page reflects the most recent revision. Material changes will be reflected on this page.
